Maintaining a trusted and safe marketplace is the main aim of Tradesafe and so we avoid using the site for unintended or unauthorized purposes. We require our users of the site to comply and agree with the Terms of Use. These Terms of Use set forth the prohibited and acceptable uses of our Site and are in respect to the other Terms of Service. Accessing the Site or using any site services after this effective date indicates you agree to the Terms. You also are responsible independently to comply with the applicable laws relating to using the site or the site services whether it is covered or not covered by the Terms.


1. PROHIBITED SITE USE The Terms of Use described are prohibited regardless of they occur on the site or not. For example, the activities prohibited are in proposals, job posts, communications with customer disputes or service, Upwork messages, Feedback and the community forum.

1.1 ILLEGAL, HARMFUL, FRAUDULENT, OR OFFENSIVE USES You may not promote, encourage, use, instruct or facilitate others to use the services or site for activities violating the law, regulation, ordinance or statute, for other harmful, fraudulent, illegal or offensive purposes or even to store, transmit, distribute, display or make the content available that is harmful, offensive or illegal.

Examples of the site or site services and the prohibited uses include: Seeking, endorsing or offering obscene, illegal or pornographic activities or services, including services (i) that violates the rights of intellectual property, copyrights of another person, product, service, entity or website or (ii) that involves review, creation or editing of obscene, erotic, pornographic or sexually explicit material;

Posting content that is defamatory, offensive, vulgar, profane, threatening, obscene, illegal, discriminatory, obscene, pornographic or sexually explicit in nature;

Seeking, endorsing or offering any services that violates our Terms of Service or other websites terms of service or any other contractual obligations;

Seeking, endorsing or offering any services that violate academic policies of educational institution; Attempting to make fraudulent bill to any client including (i) manipulating or falsifying or attempting to manipulate or falsify the keystrokes, hours or mouse clicks (ii) recording, reporting or billing clients otherwise for time not worked actually (iii) or recording, reporting or billing works that were worked as hours by another person by you that it is false or misleading;

Expressing preference in a job proposal or post or otherwise discriminating unlawfully on the basis of religion, race, national origin, color, medical condition, ancestry, mental or physical disability, genetic information, gender identity, marital status, sex, gender expression, age, gender, sexual orientation, veteran/military status or any basis by applicable law;
Violating third party rights or Posting contents harassing another person;
Posting identifying information with regards to another person;
Demanding bribes; Demanding or making payments without providing or receiving services for payment in exchange;
Spamming other Users;

Using any type of spider, robot or automated means to access site without our written permission or harvesting or collecting identifiable personal information including from the site Account names and

Engaging in conduct that is likely to harm or is intended to harm the Site, including (i) inflict disproportionately large load or load unreasonably on the infrastructure of the site (ii) interfere or attempting to interfere with the Site or Site Services operation or any activities conducted by the Site; (iii) bypassing measures we use to restrict or prevent access to the Site, including, features that restrict or prevent use or copying contents or enforce limitations on the Site use or the content therein; or (iv) attempt to interfere or compromise with the integrity of the system or the security or decipher transmissions from or to the servers running the Site.


1.2 USING THE SITE EXCLUDING THE INTENDED PURPOSES Our Tradesafe site and services is available for users to find one another as clients and employers or provider to enter into service or work relationships, receive and make payments through escrow and perform or receive the services. The users may use the site and the services for intended reasons and may not try attempt using in contravention purposes. The prohibited use examples of the site:

Providing services for obtaining positive feedback of any type; Requesting a fee to submit a proposal, before another User; Posting multiple times the same job so that more versions stay active at given time; Withhold payment or engage in any other conduct for obtaining positive feedback from another User;

Attempting to manipulate, falsify or coerce another User to give negative feedback by threatening;

Misusing the feature of feedback to express views unrelated to the work, including religious, political, or social commentary;

Sharing or Duplicating accounts; Trading, Selling or giving an account to another person without consent; Soliciting or Sharing contact information such as Skype ID, email or phone number, in a job post or profile;

Soliciting or processing payment in violation of the Terms of Service;

Advertising services or products beyond the marketplace; and placing ads to recruit people to join another company or website.


1.3 USING THE SITE TO POST MISLEADING OR FALSE CONTENT All jobs, profiles, proposals ad contents posted to the site must be honest. Prohibited Uses examples:

Misrepresenting experience, information or skills; Impersonating any entity or person, including and is not limited to, a forum leader, host or guide, or misrepresenting or falsely stating your affiliation with a entity or person; Falsely attributing statements to any forum leader, representative, guide or host; Allowing using the account to another person, which misleads other Users; Implying a relationship of work or falsely stating work with another company with whom there is no work relationship;

Implying a relationship or falsely stating about another User, including an Agency to pursue to use the information or profile after a person no longer works with the Agency; and Stating falsely that a person will perform on a job when another is performing the work in actual, including submitting proposal on behalf of another person who is unwilling, unable or unavailable to do the work.


2. ENFORCEMENT We, Tradesafe hold the right, but do not presume the obligation, to examine any violation of these Terms. We may look into the violations and disable access or modify that violates these Terms.

We may report activities that we suspect violates any regulation or law to appropriate law enforcement regulators, officials or other appropriate third parties. We may cooperate with law enforcement regulators, agencies or other appropriate third parties to help in the prosecution and investigation of illegal conduct by providing systems and network information related to alleged violations of these Terms.


3. CORRECTING AND REPORTING VIOLATIONS If you are aware of any violation of Terms, you must report immediately to our Customer Service. You agree to assist with investigation we undertake and take remedial steps we require to correct a violation of these Terms.
